La Chart Software
The La Chart provides automation and broadcasting tools to help you engage with leads and clients at scale. However, with SMS becoming more popular and robocalls increasingly regulated, it is crucial to understand and adhere to legal and industry standards. These standards are governed by various FCC regulations and TCPA laws.
As a La Chart customer, you explicitly certify and warrant that you adhere to the guidelines below for all originating or terminating voice, SMS, or email traffic through your account.
These guidelines apply to all use of La Chart features including the Power Dialer, bulk SMS, bulk ringless voicemail (RVM), automation sequences, and any use of our phone numbers in either outbound messaging or generating inbound communications.
Enforcement Levels
These rules are enforced at three levels:
1. La Chart
We may occasionally review your account for compliance. Any violation, determined at our discretion, may result in suspension or termination of your account without prior notice. Refunds are not issued to banned or suspended accounts.
In the event of account suspension—whether for a violation of these terms or non-payment—all phone numbers in your account are disconnected, forfeited, and subject to immediate release, at our sole discretion.
2. Carriers
Our carrier partners occasionally review traffic originating from La Chart accounts. Carriers—both originating and terminating—have their own spam filters and blocking protocols based on content and volume. La Chart does not control these filters. If your messages are being blocked, your content may be flagged at the carrier level.
3. Government Oversight
FCC and TCPA regulations allow recipients of messages to file complaints regarding unauthorized contact. In the event of such complaints, La Chart may forward supporting documentation (including your name and address) to the requesting government entity, law enforcement agency, or court without prior notice. You expressly authorize us to release such information when required by law.
Acceptable Use Requirements
These rules apply to all campaigns using La Chart, including bulk SMS, automation, outbound calls, or advertising using La Chart-provided phone numbers.
If you use La Chart’s API or operate on behalf of other clients, it is your responsibility to ensure compliance across all accounts. Any violations may result in immediate account suspension.
Forbidden Content
The following categories are strictly prohibited from being sent through La Chart:
S – Sex: Pornography, sex/human trafficking, prostitution, adult video chat services
H – Hate: Abuse, discrimination, violence, threats, harassment
A – Alcohol: Sale, promotion, or encouragement of alcohol consumption
F – Firearms: Sale, distribution, or promotion of guns or ammunition
T – Tobacco: Includes nicotine, vaping, cannabis, and CBD products
Additional prohibited categories include:
Payday loans
Loan/Debt consolidation or forgiveness
Debt collection
Credit repair
Tax refund loans
Gambling/casinos
Multi-level marketing (MLM), pyramid schemes
Malware, spyware, or malicious links
Customer support for brands you’re not authorized to represent
Consent (Opt-In) Requirement
You must have prior written consent (proof of opt-in) from every subscriber you message or call.
You must retain documentation showing opt-in consent.
La Chart may request this documentation at any time.
TCPA requires businesses to retain proof of consent for multiple years.
Opt-Out Management
You must provide clear and easy methods for subscribers to opt out of communications.
Recipients should be able to reply with any variation of “Stop” or “Unsubscribe.”
Once an opt-out request is received, the subscriber’s number must be removed from all messaging lists immediately.
La Chart automatically suppresses contacts who reply with an opt-out keyword like “Stop.”
Best Practice: Always include the line: “Reply STOP to unsubscribe” in your messages.
Do Not Call (DNC) Compliance
You are responsible for ensuring your contact list does not include numbers on the national or state Do Not Call registries.
La Chart’s internal DNC utility does not cross-check with national DNC lists and should only be used for your internal tracking.
We reserve the right to inspect message traffic to confirm DNC compliance.
Any message sent to a DNC-registered number may incur a $5 per instance surcharge.
Misleading or Malicious URLs
You may not include links that:
Redirect to fraudulent or phishing websites
Collect personal or financial data under false pretenses
Lead to sites that automatically trigger software downloads
Mislead or misrepresent the nature of your offer
Misrepresentation & Licensing
If you represent another company, product, or government agency, you must be properly licensed and authorized to do so.
You may not imply affiliation with any entity unless explicitly permitted.
Trademark use without authorization is strictly prohibited.
High-Volume and Time-Restricted Messaging
You may not send multiple successive messages to recipients who are not engaging in two-way communication.
Do not send messages outside of approved hours (8:00 AM – 9:00 PM local time of recipient).

We recommend reviewing examples of compliant and non-compliant messaging to better understand best practices. If your message content does not follow the law or carrier guidelines, it may be blocked or your account suspended.
